Настоящий документ является публичной офертой. Акцептом оферты признаются регистрация на сайте HookGuard и/или оплата услуг. С момента акцепта договор считается заключённым.

2.1. Продавец предоставляет доступ к платформе: размещение товаров авторов, продажа цифрового доступа к ним, внутренний кошелёк, привязка доступа по HWID, техническая поддержка.
2.2. Физические товары не продаются, не пересылаются и не доставляются. Все товары — цифровые.
2.3. Товары создают и описывают авторы. Продавец обеспечивает работу витрины, приём оплаты, выдачу доступа и модерацию листингов.
3.1. Для покупок и публикаций требуется аккаунт: e-mail, пароль и код подтверждения. Регистрируясь, пользователь принимает условия пользования, настоящую оферту и политику обработки персональных данных.
3.2. Пользователь обязуется хранить пароль в тайне и не передавать доступ третьим лицам.
3.3. Продавец вправе заблокировать аккаунт при нарушении условий сервиса, мошенничестве или по требованию закона.
4.1. Цена товара указывается в его карточке до оплаты, в рублях РФ, и включает все применимые налоги продавца. Отдельной платы за «доставку» нет — цифровой доступ выдаётся бесплатно после оплаты.
4.2. Оферта заключается на сайте https://hookguard.ru. Оплата выполняется онлайн через платёжных партнёров (Prodamus, Lava): банковская карта, СБП и иные доступные способы. Продавец не хранит и не обрабатывает полные данные банковских карт — они передаются напрямую платёжному партнёру по защищённому соединению.
4.2.1. Для пополнения кошелька партнёру выставляется одноразовый счёт на сумму, которую покупатель выбирает сам в пределах от 50 до 25 000 ₽ (для валютных счетов — от эквивалента в 5 $/5 €). Счёт не является подпиской: регулярных списаний с карты продавца или партнёра не производится.
4.3. Сначала пополняется кошелёк, затем с него списывается стоимость товара или тарифа. Лимит баланса кошелька — 100 000 ₽.
4.4. Чек формируется в соответствии с требованиями законодательства о налоге на профессиональный доход и направляется покупателю.
4.5. Комиссия платформы с продаж авторов составляет 35%. Выручка автора удерживается 2 (двое) суток после продажи (клиринг), затем зачисляется на доступный баланс и может быть выведена.
4.6. Кошелёк пополняется по подтверждению оплаты от платёжного партнёра (веб-уведомление), а не по факту возврата браузера на сайт: переход на страницу успеха сам по себе основанием для зачисления не является. Если банк покупателя отменил операцию или оспорил её (chargeback), соответствующая сумма списывается с кошелька, а доступ по оплаченным ею покупкам блокируется до урегулирования спора.
5.1. Цифровой доступ выдаётся в личном кабинете сразу после подтверждения оплаты: код лоадера, активация срока подписки, возможность привязки HWID.
5.2. Услуга считается оказанной с момента предоставления доступа (выдача лоадера / активация срока), в соответствующей части. Подробно способ и сроки описаны в документе «Доставка».
5.3. Если доступ не появился в течение 1 рабочего дня после успешной оплаты, покупатель вправе обратиться в поддержку — доступ будет выдан вручную либо оформлен возврат.
На платформе запрещены товары и услуги, запрещённые законодательством РФ, в том числе: вредоносное ПО (стилеры, майнеры, шифровальщики, фишинг); порнография; призывы к правонарушениям, терроризм, рознь; оборот запрещённых препаратов; алкоголь и табак; подделки и контрафакт; магические услуги; финансовые пирамиды и инвестпроекты; обмен валют; подбор займов; телемаркетинг. Такие листинги удаляются, аккаунт блокируется, выплаты могут быть удержаны.
Покупатель получает простую (неисключительную) лицензию на использование товара в пределах оплаченного срока, без права перепродажи, сублицензии и передачи исключительных прав. Подробно — в документе «Лицензия ПО».
Условия возврата и отмены платежа установлены в документе «Возврат и отмена», который является неотъемлемой частью настоящей оферты.
11.1. Сервис предоставляется «как есть». Продавец не отвечает за содержание товаров авторов, за сбои сетей связи, банков и платёжного партнёра, а также за убытки, вызванные нарушением условий сервиса самим пользователем.
11.2. Совокупная ответственность продавца по любому требованию ограничена суммой, уплаченной пользователем за товар, с которым связано требование.
12.1. Претензии направляются на e-mail impretklis@gmail.com или по телефону +7 (958) 283-10-93. Срок ответа — до 10 рабочих дней.
12.2. При недостижении согласия спор разрешается в суде по месту жительства продавца в соответствии с законодательством РФ.
Новая редакция публикуется на этой странице и действует с момента размещения. К оплаченным ранее заказам применяется редакция, действовавшая на момент оплаты.

2.1. The seller provides access to the platform: hosting author products, selling digital access to them, an internal wallet, HWID access binding and technical support.
2.2. No physical goods are sold, shipped or delivered. All products are digital.
2.3. Products are created and described by the authors. The seller ensures the storefront works, accepts payments, issues access and moderates listings.
3.1. Purchases and publishing require an account: e-mail, password and a confirmation code. By registering, the user accepts the Terms of Use, this offer and the Personal Data Processing Policy.
3.2. The user undertakes to keep the password secret and not to grant access to third parties.
3.3. The seller may block an account upon violation of the service terms, fraud or by legal requirement.
4.1. The price is shown in the product card before payment, in Russian rubles, and includes all applicable seller taxes. There is no separate "delivery" fee — digital access is issued free of charge after payment.
4.2. This offer is concluded on the site https://hookguard.ru. Payment is made online through payment partners (Prodamus, Lava): bank card, SBP (Faster Payments System) and other available methods. The seller does not store or process full bank card data — it is transmitted directly to the payment partner over an encrypted connection.
4.2.1. For a wallet top-up a one-time invoice is issued to the partner for the amount the buyer chooses, within 50 to 25,000 RUB (currency invoices start from the equivalent of 5 USD/EUR). The invoice is not a subscription: no recurring charges are made by the seller or the partner.
4.3. The wallet is topped up first, then the price of the product or plan is charged from it. Wallet balance limit — 100,000 ₽.
4.4. A receipt is issued in accordance with the professional income tax legislation and sent to the buyer.
4.5. The platform fee on author sales is 35%. Author revenue is held for 2 (two) days after the sale (clearing), then credited to the available balance and can be withdrawn.
4.6. The wallet is credited on the payment partner's confirmation (webhook), not when the browser returns to the site: reaching the success page is not by itself a ground for crediting. If the buyer's bank reverses or disputes the charge (chargeback), the amount is debited from the wallet and access to the purchases it paid for is suspended until the dispute is resolved.
5.1. Digital access is issued in the personal cabinet immediately after payment confirmation: loader code, subscription period activation, and the ability to bind HWID.
5.2. The service is considered rendered from the moment access is provided (loader issuance / period activation), to the corresponding extent. The method and timing are described in detail in the "Delivery" document.
5.3. If access does not appear within 1 business day after a successful payment, the buyer may contact support — access will be issued manually or a refund will be processed.
The platform forbids products and services prohibited by the legislation of the Russian Federation, including: malware (stealers, miners, ransomware, phishing); pornography; calls to criminal acts, terrorism and discord; trafficking of prohibited substances; alcohol and tobacco; counterfeits; magic services; financial pyramids and investment schemes; currency exchange; loan brokering; telemarketing. Such listings are removed, the account is blocked, and payouts may be withheld.
The buyer receives a simple (non-exclusive) license to use the product within the paid period, without the right of resale, sublicensing or transfer of exclusive rights. Details — in the "Software License" document.
Refund and cancellation conditions are established in the "Refund and Cancellation" document, which is an integral part of this offer.
11.1. The service is provided "as is". The seller is not responsible for the content of authors' products, for failures of communication networks, banks and the payment partner, or for losses caused by the user's own violation of the service terms.
11.2. The seller's aggregate liability for any claim is limited to the amount paid by the user for the product related to the claim.

12.2. Failing an agreement, disputes are resolved in the court at the seller's place of residence in accordance with the legislation of the Russian Federation.
A new edition is published on this page and takes effect from the moment of publication. Previously paid orders are governed by the edition in force at the time of payment.
